Hino Truck Emissions Settlement

Settlement Summary

A proposed class action settlement has been reached with Hino Motors Ltd., Hino Motors Manufacturing U.S.A., Inc., and Hino Motors Sales U.S.A., Inc. in the lawsuit Express Freight International, et al. v. Hino Motors, Ltd., et al., No. 1:22-cv-22483. The lawsuit claims that certain Hino trucks had emissions levels that were misrepresented and exceeded regulatory standards. Although the defendants deny these allegations, they have opted to settle.

Benefits of the Settlement

The settlement, pending approval, offers compensation and other benefits to class members who submit a valid claim. Key benefits include:

• A settlement fund of $237,500,000 designated for compensating class members, with individual payments likely ranging from $1,500 to $15,000 per eligible truck.

Additional benefits include:

• An extended warranty for the emission control system components, covering both parts and diagnostic test costs.
• A new parts warranty for government-mandated or recommended emissions system recalls or repairs over the next three years.

Eligibility for Compensation

If you or your company owned or leased a qualifying Hino truck on or before October 30, 2023, you might be eligible for a significant payment from the $237.5 million settlement fund. Eligible trucks are those equipped with Hino engines, from model years 2010 to 2019, sold in the U.S.:

• Hino 155, 195, 238, 258, 268, 338 (Model Years 2011-2020)
• Hino XL7, XL8 (Model Year 2020)
• Hino L6, L7 (Model Year 2021)

Eligibility will be verified by the vehicle's VIN and includes most, if not all, of the above models.
